Social hearing named me the custodial parent, can the judge change that when we go to the judge?

We went to court a couple days ago, it was a social hearing for custody, I ended up being named domiciliary parent. She is to have visitation every other week. Will the judge or can the judge override this ruling?





She refused to take a drug test, Saying if she could be given 2 more weeks she could be clean. I could not believe she said that. She got really loud with the social worker to the point that the social worker threw her out of the room told her to go wait in the lobby. I was given custody and she has to pay child support as of may first.





Do you think the judge will over rule this when we go back to court? Thanks for you needed answers, I worry about my kids.

Good for you!! No, I don't think the judge will over rule this decision. The social worker should appear in court of any future hearings, she will be more than happy to let the judge know how your ex acted and refused a drug test. It's global re-cycling. Every thing on that site is free, do you need dressers, night stands, lamps, dishes? Just remember later in life, when you get ready to toss out used items. Post them in freecycle, someone can use them.

Reply:The judge does have the power to overrule the current order, but probably won't (and from what you've written I really doubt he would have any reason to). They'll take the previous findings heavily into consideration. You'll do even better if the people who witnessed her behavior are there to speak on your behalf.
Reply:Honestly it depends on the judge and the state...The judge has the right, but it depends on the law in the state thus far...In Nebraska, for example, where I'm from...they give custody to the mother-Unless something really major happens...no matter how more fit the father is-trust me, I know from personal experience..
